ICJ updates: Court orders Israel to prevent acts of genocide in Gaza
Israel has been asked by the International Court of Justice to stop committing genocide amid its Gaza War. It did not, however, go so far as to demand an end to hostilities in the ongoing South African lawsuit.
“At least a few of Israel’s actions and inactions in Gaza seem to be capable of being classified as genocide under the terms of the convention on the prevention of genocide. Based on Article 9 of the Genocide Convention, the court determines that it has prima facie jurisdiction to consider the complaint in light of the following. Judge Joan E. Donoghue declared, “The court cannot grant Israel’s request that it not consider the application.
An ICJ ruling is difficult to implement even though it has legal authority. A final decision over whether Israel is committing genocide against the Palestinians might take years, according to legal experts.
Here are a few salient points from the decision:
According to Donoghue, “at least some of the acts and omissions that Israel is alleged to have committed in Gaza appear to be capable of falling within the provisions of the (Genocide) Convention.”
The Court granted South Africa’s request for temporary measures against Israel, ruling that the country has standing to pursue the matter. Israel has requested that the court not entertain the application, but the court “cannot accede to that request.”
Under the Genocide Convention, Palestinians were deemed to be a protected group by The Hague’s judges. The right of the Palestinian people in Gaza to be shielded from genocide was emphasized, along with the statement that “at least some of the rights claimed by South Africa and for which it is seeking protection are plausible.”
Israel has been directed to take action to prevent its troops from engaging in acts of genocide and to punish those who encourage such activity. Additionally, the ICJ demands that Israel take action against any public calls for genocide.
Also, the ICJ requested that Israel permit humanitarian aid to reach Gaza.
Within a month, the country led by Benjamin Netanyahu is expected to provide an update to the International Court of Justice. The nation was also required to retain records of any acts that had an influence on the Genocide Convention by the UN organization.
